it seems somewhat weak, to me, to use the analogy to person property to discuss data ownership rights

much in the same way that giving away a pirated copy of a film isn't theft, because nobody lost anything, it seems to me that under this framework it's not really feasible to say that copying some data from a website is theft

not to say that it's okay to do that; just that we need a better analogy.
